Terms and Conditions

These general terms and conditions (T&Cs) apply to all services provided by Musclemorphosis by FMK e.U., owner Frieda Maria Kapsamer. These include in particular 1:1 and 2:1 personal training, online coaching, the creation of training concepts and, where applicable, workshops and other coaching offers.

By booking an offer via the website, MyPT-Hub, by email or by personal agreement, the customer accepts these T&Cs.

The subject of the contract is the provision of individual training and coaching services in the field of fitness and health as well as the creation of training concepts. The services support physical performance, movement quality and general health, but do not replace medical or psychotherapeutic treatment.

A contract is concluded by booking via the website or the coaching platform (e.g. MyPT-Hub) and confirmation of the booking or appointment, or by written or electronic registration (email, form) and confirmation by the trainer.

The trainer reserves the right to decline enquiries without stating reasons, for example in the case of clearly unsuitable goals or health concerns.

The trainer provides her services to the best of her knowledge and belief, individually adapted to the customer's goals, starting point and tolerance of training load.

Type, scope, location and duration of the sessions are agreed during booking or in the first consultation; the trainer may make reasonable changes that serve safety (e.g. moving to another studio, adapting a session).

Group training or workshops only take place if a minimum number of participants is reached; if they are cancelled, alternative dates are offered or payments already made are refunded.

The applicable prices are stated on the website, in the offer or in the booking platform.

Payment is generally made in advance (single sessions, blocks, programmes) unless otherwise agreed, by bank transfer or online payment methods.

When booking training blocks or coaching programmes, the total price is due at the start of the programme; unused sessions may expire after the agreed period if the offer states this.

Individual appointments can be cancelled free of charge up to 24 hours before the agreed time; after that the full session is charged or considered used.

If you do not show up without prior cancellation, the full amount is due.

The trainer may cancel appointments for important reasons (e.g. illness, force majeure, studio closure); in this case an alternative date is offered and payments already made remain valid.

For coaching programmes concluded online, the statutory rights of withdrawal under the Austrian Distance and Off-Premises Transactions Act (FAGG) apply. During the booking process the customer is informed about any right of withdrawal, its period (generally 14 days) and possible exceptions for leisure services with a fixed date.

The customer confirms that they will truthfully inform the trainer of all relevant information about their physical and health situation, in particular illnesses, injuries, surgeries, medication, pregnancy and other factors that may affect training safety.

Participation in training and coaching takes place at the customer's own responsibility and risk; the trainer does not provide medical diagnosis or therapy.

The trainer is liable within the scope of statutory provisions; liability for slightly negligent breaches of duty is excluded, with the exception of personal injury. No liability is accepted for damage resulting from incomplete or incorrect information provided by the customer or from disregarding instructions.

All documents, training plans, videos and other content provided by the trainer are protected by copyright and remain her intellectual property.

Sharing, publishing, reproducing or commercially using the content without prior written consent is not permitted.

Personal data is processed in accordance with the applicable privacy policy of Musclemorphosis by FMK e.U., which is available on the website or provided to the customer before the contract is concluded.

Health and training data is processed only on the basis of separate consent.

Austrian law applies, excluding its conflict-of-law rules.

The place of jurisdiction for any disputes is – as far as legally permissible – Vienna.

Amendments and additions to these T&Cs must be made in writing; this also applies to any waiver of this written form requirement.

Should any provision of these T&Cs be or become wholly or partly invalid, the validity of the remaining provisions remains unaffected; the invalid provision shall be replaced by one that comes closest to its economic purpose.
